Interpretation and Definitions

Interpretation

Words whose initial letters are capitalized have the meanings defined below. These definitions apply whether the terms appear in singular or plural form.

Data We Collect

We collect different categories of Personal Data depending on how you use the Service.

3.2 Usage Data

Usage Data is collected automatically when you use the Service. It may include your Device type, operating system version, App version, time zone, features accessed, session duration, streaks, milestone achievements, and crash or diagnostic logs. We do not collect precise geolocation data.

3.3 Payment Information

Subscription purchases are processed through the Apple App Store or Google Play Store, depending on your device. We do not collect or store your payment card details. Your payment is handled entirely by the relevant app store platform under its own terms and privacy policy. We receive only confirmation of your subscription status and entitlement from the platform.

3.4 Tracking Technologies

We use standard mobile analytics tools to understand how the App is used. These tools may collect device identifiers and usage patterns. We do not use advertising cookies, cross-site tracking technologies, or remarketing tools. Where applicable law requires consent before setting non-essential tracking technologies, we will seek that consent.

How We Use Your Data

We use Personal Data only for the purposes listed below.

We do not sell Your Personal Data. We do not share your Personal Data with third parties for their own marketing or advertising purposes. We do not use Conversation Content to target advertisements at you.

Section 05

Conversation Handling

Conversations you have with the Mitr AI companion receive heightened protection. The commitments in this section are binding.

Service Providers

We engage the following Service Providers to operate the Service. Each is engaged under contractual terms consistent with this Privacy Policy. Service Providers process data only as directed by us and may not use it for their own purposes.

We may add, replace, or remove Service Providers over time. Where a change involves a new AI processing partner, that partner will be held to the same standards: no training on Conversation Content, and zero or short retention of submitted content. We will update this section when such changes occur.

Section 07

Sharing Your Data

We share Personal Data only in the following circumstances.

With Service Providers

As described in Section 6. Service Providers are contractually bound to process data only as directed by us.

For Business Transfers

If the Company is involved in a merger, acquisition, or asset sale, your Personal Data may be transferred. We will provide notice before your Personal Data becomes subject to a materially different privacy policy as a result of such a transaction.

For Legal Compliance

We may disclose Personal Data where we have a good-faith belief that disclosure is required to: (a) comply with a legal obligation or lawful request from a government or law-enforcement authority; (b) protect the vital interests of any person; (c) investigate or prevent fraud, security incidents, or violations of our Terms of Service; or (d) establish, exercise, or defend legal claims.

With Your Consent

We may share your Personal Data for other purposes with your express, prior consent.

Sale of Personal Data

We do not sell Your Personal Data. We have not sold any Personal Data in the past 12 months and do not currently do so. If this ever changes, we will update this Policy and provide any required opt-out mechanism before any sale occurs.

Cross-Context Behavioral Advertising

We do not share your Personal Data with third parties for the purpose of targeting advertising to you based on your activity across different services. No opt-out is required because no such sharing occurs.

Section 08

AI and Automated Processing

8.1 AI Companion

When you send a message in the chat feature, that content — along with sufficient session context to generate a coherent reply — is transmitted to Anthropic's API. Anthropic processes this content to return a generated response. We do not share your identity or full account details with Anthropic; messages are transmitted with a session reference only.

The AI companion is not a medical professional, therapist, or licensed counselor. Responses are generated by an automated system and reflect probabilistic outputs, not professional advice. The Service is not a substitute for professional mental health support.

8.2 Crisis Detection

The Service includes an automated safety layer that analyzes message content for indicators of potential self-harm or crisis. Where a potential indicator is detected, the Service will surface crisis support resources within the conversation. See Section 14 for more detail.

8.3 No Solely Automated Consequential Decisions

We do not use automated processing alone to make decisions that have significant legal or equivalent effects on you. No account action is taken solely on the basis of automated processing without human review.

Section 09

Data Retention

We retain Personal Data only for as long as is necessary for the purposes described in this Policy, unless a longer period is required by law.

We may retain Personal Data beyond these periods where required by law, to resolve disputes, enforce agreements, or to fulfill legitimate operational purposes. Where we do so, we will inform you of the basis for continued retention upon request.

Section 10

Your Privacy Rights

Depending on where you live, you may have some or all of the following rights regarding your Personal Data. Specific additional rights for EU/UK residents and California residents are set out in Sections 11 and 12.

How to Submit a Request

Contact us at privacy@bewithmitr.com with the subject line "Privacy Request — [Nature of Request]." We may need to verify your identity before processing your request. We will acknowledge your request within 5 business days and respond substantively within 30 days (or within the period required by the law of your jurisdiction, if shorter).

You will not face any penalty, service reduction, or discrimination for exercising your privacy rights.

GDPR Privacy

International Transfer of Personal Data

We may transfer, store, and process Personal Data in countries other than the country in which you are located, including the United States, where data protection laws may differ. Where we transfer Personal Data outside the EEA or UK to a country without an adequacy decision, we rely on appropriate safeguards, including the European Commission's Standard Contractual Clauses (SCCs) and, for UK transfers, the International Data Transfer Agreement (IDTA) or the UK Addendum to the SCCs, together with supplementary measures such as encryption in transit and at rest. You may request a copy of the relevant contractual protections by contacting us.

CCPA / CPRA Privacy Notice (California Residents)

This section applies solely to residents of California. It supplements the information in this Policy and is provided in accordance with the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA).

Sources of Personal Information

Use and Disclosure of Personal Information

We use and disclose personal information for the business purposes described in Section 4. We disclose the following categories to Service Providers: Categories A, D, F, and (where voluntarily provided in Conversation Content) C and L. Service Providers may only use this information to perform services on our behalf.

Your CCPA / CPRA Rights

Exercising Your CCPA / CPRA Rights

Submit requests by email to privacy@bewithmitr.com. We will acknowledge your request within 10 business days and respond within 45 days. We may extend this period once by a further 45 days with prior notice. We will need to verify your identity before responding. Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable request. We will not charge a fee for up to two requests per 12-month period.

Minors (California)

We do not sell or share personal information. The Service is not available to anyone under 18 years of age, as described in Section 13. We therefore do not knowingly collect personal information from any California resident under 18, including the categories of minors to whom the CCPA opt-in requirement applies.

California's Shine the Light Law

We do not share Personal Data with third parties for their own direct marketing purposes. If you wish to confirm this in writing, contact us at privacy@bewithmitr.com.

California Minor Users (Cal. Bus. & Prof. Code § 22581)

California residents under 18 who are registered users may request removal of content or information they have publicly posted by contacting us at privacy@bewithmitr.com. Please note that removal may not be complete or comprehensive in all circumstances.

Do Not Track

Our Service does not respond to Do Not Track signals from browsers. We do not use cross-site tracking technologies.

Section 13

Minimum Age and Children

The Service is available to users aged 18 and older. We do not knowingly collect Personal Data from anyone under the age of 18. If you are a parent or guardian and believe your child under 18 has used the Service, contact us at privacy@bewithmitr.com and we will take steps to delete such information promptly.

Why the minimum age is 18 everywhere: Data protection laws set different minimum ages in different countries. India's Digital Personal Data Protection Act 2023 defines a child as any individual below 18 years of age. Rather than apply a different rule in each country, we set a single minimum age of 18 worldwide. No account may be created by anyone under 18 in any country, and we do not process the personal data of children.

In jurisdictions where the minimum age for digital services is higher than 18, the higher threshold applies. If we learn that we have collected Personal Data from a user below the applicable minimum age without the required consent, we will delete that information promptly.

User safety is our overriding priority. If our automated safety systems detect content indicating an immediate risk to life — yours or another person's — the following applies:

Section 15

Security

The security of your Personal Data is important to us. We implement technical and organizational measures designed to protect it against unauthorized access, disclosure, alteration, and destruction. These include encryption of data in transit (TLS 1.2 or higher), encryption of data at rest, access controls limiting personnel access to data on a need-to-know basis, and secure development practices.

No method of transmission over the internet and no method of electronic storage is 100% secure. While we strive to use commercially reasonable means to protect your Personal Data, we cannot guarantee its absolute security. If you have reason to believe your interaction with us is no longer secure, please notify us immediately at privacy@bewithmitr.com.

In the event of a personal data breach likely to result in a risk to your rights and freedoms, we will notify the relevant supervisory authority within the timeframes required by applicable law and inform affected users as required.

Section 16

International Transfers

Zarsh Services Inc. is based in the United States. When you use the Service from outside the United States, your Personal Data will be transferred to and processed in the United States and potentially in other countries where our Service Providers operate.

Where Personal Data originating from the EEA or UK is transferred to a country without an adequacy decision, we rely on Standard Contractual Clauses (SCCs) or the UK International Data Transfer Agreement (IDTA) or UK Addendum, supplemented by measures such as encryption in transit and at rest. We transfer Personal Data internationally only as necessary to provide the Service and work with our Service Providers. You may request further information about the safeguards we use by contacting us.

For the transfer of Personal Data from India, we comply with the cross-border transfer provisions of the DPDP Act 2023 as they become operative.

Third-Party Links

The Service may contain links to third-party websites or services not operated by us. Clicking a third-party link will direct you to that party's site. This Policy does not apply to those services. We have no control over and accept no responsibility for the privacy practices or content of any third-party service. We encourage you to review the privacy policy of every service you access.

Section 18

Changes to This Policy

We may update this Policy from time to time to reflect changes in our practices, the Service, or applicable law. When we make material changes, we will:

Your continued use of the Service after the effective date of a revised Policy constitutes your acceptance of the changes. If you do not agree to the revised Policy, you should stop using the Service and may request deletion of your account.

Section 20

Events, Venues, and Gatherings

The Service may present recommendations for in-person events, community gatherings, spiritual centers, and wellness venues. These recommendations may be sourced from third-party data providers — including the Google Places API — or submitted by other users of the Service. This section governs your use of those recommendations and any decision you make to attend an event or visit a venue as a result.

20.1 Third-Party Venue and Event Data

Venue and event information sourced from the Google Places API or any other third-party data provider is supplied for general informational purposes only. Mitr does not independently verify the accuracy, completeness, currency, legality, safety, or suitability of any such information. The appearance of a venue or event within the Service does not constitute an endorsement, certification, or approval by Mitr of that venue, its operators, its activities, or the individuals associated with it.

Third-party data — including venue names, addresses, hours, ratings, and descriptions — is subject to the accuracy limitations and terms of the data provider. Mitr is not liable for any error, omission, or change in information provided by Google or any other external source.

20.2 User-Generated Events and Gatherings

Other users of the Service may create and publish event listings, group gatherings, or community activities that are visible to other users. Mitr does not verify, screen, approve, or endorse any user-generated event or gathering. The content of user-generated events reflects the representations of the individual who created them, not the views, standards, or endorsements of Mitr.

Mitr reserves the right — but is not obligated — to remove, modify, or decline to display any user-generated event listing at any time and for any reason, without notice.

20.3 Your Decision to Attend

The decision to attend any event, gathering, or venue recommended or listed through the Service is made entirely at your own discretion and risk. Before attending, you are solely responsible for conducting your own assessment of the event's safety, suitability, and legitimacy. You should verify independently any information material to your decision to attend, including the identity and credentials of any organizer.

Mitr is not responsible for, and expressly disclaims all liability in connection with:

20.4 No Guarantee of Outcomes

Attendance at any recommended event or gathering does not guarantee any specific result. A recommendation made through the Service — whether sourced from third-party data or generated by other users — does not carry any representation or warranty by Mitr that attending will produce a spiritual, mental, physical, emotional, social, or any other outcome. Individual experiences vary. Mitr makes no express or implied warranty that any event, gathering, or venue will meet your expectations or needs.

Nothing in the Service constitutes professional advice — spiritual, medical, psychological, legal, or otherwise — about whether a particular event, gathering, or practice is appropriate for you.

20.5 Safety

You are solely responsible for your personal safety when attending any event or visiting any venue. If you have concerns about the safety of an event or the identity of an organizer, do not attend. If you become aware of any event listing that appears fraudulent, unsafe, or in violation of our Terms of Service, report it to us at privacy@bewithmitr.com.

Section 21

The Intention Tab and Intention Wall

The Intention Tab is a dedicated area of the Service that allows users to share what they are carrying — a worry, a grief, a fear, a hope — and to receive wordless support from the Mitr community. This section explains how information in the Intention Tab is collected, processed, stored, and shared, and describes the privacy protections built into this feature.

Important distinction: Intention posts are visible to other users of the Service within the Intention Wall. This is different from private Conversation Content you send to the AI companion, which is never visible to other users. Before you post an intention, please be aware that other members of the Mitr community will be able to read what you have written for up to 48 hours.

21.1 Information Collected in the Intention Tab

21.2 The Public Nature of Intention Posts

When you share an intention, it is published to the Intention Wall and is visible to all users of the Service for a period of up to 48 hours (24 hours by default, with one optional renewal). You should not include information in an intention post that you would not be comfortable with other Mitr users reading.

Although intention text is potentially sensitive in nature, it is not treated as private Conversation Content under Section 5 of this Policy because it is voluntarily shared to a community audience. We process intention text to: deliver it to the Intention Wall; run a pre-posting safety check (see Section 21.4); select an anchoring verse; and generate anonymized aggregate community themes.

We do not use your intention text to train AI models, to target advertising, or for any purpose beyond those described in this Policy.

21.3 Anonymity Controls

The anonymous posting toggle is set to on by default. When anonymous is on, your name is not shown on your intention post — other users see only the text of the intention. When you disable the anonymous toggle, your display name becomes visible to all users who can see the post, for as long as the post is live.

Your choice of anonymous status is recorded alongside your intention and is not changeable after the intention has been posted. If you posted under your name and wish to change the text of your intention, you may do so within 15 minutes of posting as described in Section 21.10. After that window closes, the post cannot be changed.

21.4 Safety Check Before Posting

Every intention text is checked by an automated safety system for indicators of crisis or self-harm before it is saved or published. This check runs before any data is written and cannot be bypassed. If a crisis indicator is detected, the intention is not posted and you are offered immediate access to crisis support resources. Crisis resources are also displayed at all times on the intention sharing screen, regardless of the content you are writing. See Section 14 for the full list of crisis resources.

21.5 Sitting With an Intention

When you tap to sit with another user's intention, a record linking your account to that intention is created and stored in our database. This record is used only to enforce the one-sit-per-person rule and to increment the public sitting count. The record is never made visible to the person who posted the intention, to other users who have sat with it, or to any third party. Sitting is fully anonymous.

You cannot reverse a sitting action after it has been made.

21.6 Lifecycle and the Peace Journal

Every intention lives on the Intention Wall for 24 hours from the time of posting. You may renew it once, extending it by a further 24 hours. The maximum time any intention can remain visible on the wall is 48 hours.

When an intention closes — when its time expires — the following occurs:

Peace Journal entries containing former intention posts are private to you. They are not visible to other users, to Mitr, or to any third party except in circumstances described in Sections 7 and 14.

21.7 Community Themes — "What We're Carrying"

Each week, Mitr generates a report of the broad themes shared across the Intention Wall — for example, "family," "loss," or "new beginnings." This report is displayed to the community as an aggregated summary. It is intended to reflect shared human experience across the Mitr community.

The following protections apply to this feature:

21.8 Sharing and Invitations

You may invite someone to sit with your intention by generating a link. That link, when tapped by the recipient:

Invitations you send do not include your sitting count. The message a recipient receives contains only an invitation to sit — it does not carry engagement metrics that could embarrass you if few people have sat with your post.

You may also share your intention via messaging platforms such as WhatsApp. When you use this feature, the text of your intention, the verse associated with it, and a link back to the Service are included in the shared message. You are responsible for the recipients you choose to share with. Once content has been shared externally via a third-party messaging platform, Mitr has no control over how that content is further shared, saved, or distributed by the recipient or by the platform.

21.9 Moderation

The Service does not include a post-level flag or report button on individual intention posts. If you have a concern about content you see on the Intention Wall, you may submit feedback through the in-app feedback button, which is available throughout the Service. Feedback submitted this way is received by our moderation team at team@bewithmitr.com and reviewed typically within 24 hours.

Mitr reserves the right to remove any intention post at any time, without notice to the poster, if feedback received through the app indicates the post may violate our Terms of Service or if our moderation team determines it to be harmful to the poster or to other users. Feedback submitted through the in-app feedback button is not visible to other users or to the person who posted the intention under review.

21.10 Editing Your Intention

You may edit the text of your intention within 15 minutes of posting. During this window, changes you make are saved immediately and the updated text is what other users see on the Intention Wall. After the 15-minute edit window closes, the text of your intention is fixed and cannot be changed for the remainder of its time on the wall.

You cannot delete your intention post. Once posted, an intention remains on the wall until its time expires, and is then retained in your Peace Journal or held state as described in Section 21.6. If you have a concern about an intention you have posted, contact us at privacy@bewithmitr.com and we will review it.

Shareable Cards and Content

The Service allows you to generate and share formatted content cards via third-party messaging and social platforms — including WhatsApp, Apple Messages, Instagram, and any other platform accessible through your device's native share sheet. This section describes what each type of shareable content contains, your responsibilities when you choose to share, and the limits of Mitr's control once content leaves the Service.

22.1 Types of Shareable Content

The Service currently offers the following categories of shareable content:

Verse Share Card A verse from the Bhagavad Gita or related corpus, displayed in Mitr's own rendering (not a verbatim translation); the precise source citation (book, chapter, verse); Mitr attribution and branding. Your identity as a Mitr user (by virtue of the Mitr attribution on the card). No account information beyond what you voluntarily include in a personal note.
Milestone Share Card Your milestone name (e.g., First Roots, Branch, Root, Waters, Bud, or Lotus), the number of consecutive days you have used the Service, the pre-curated verse assigned to that milestone, and Mitr attribution. How long you have used the Service continuously. Your identity as a Mitr user. The milestone name, which discloses your engagement level to the recipient.
Intention Wall Preview The text of your intention post, the verse Mitr associated with it, and a link back to the Service. The sitting count is included in some share formats. See Section 21.8 for full details. The content of what you have shared on the Intention Wall. Your identity as a Mitr user. Potentially sensitive personal information you have chosen to write in an intention post.
"What We're Carrying" Weekly Card The weekly aggregated community theme (e.g., "1,247 people are carrying something about family this week"), and Mitr attribution. No individual data is included. That you are a Mitr user. No personal information about your own usage or content.
Annual Review Card A summary of your engagement with the Service during the preceding year — including days active, longest streak, most-saved verse, and other usage statistics — presented in a formatted card with Mitr attribution. Detailed information about how you have used the Service over a 12-month period, including your level of engagement, the verse content that resonated with you most, and periods of heavier or lighter use. This card contains the most personal usage information of any shareable artifact.

22.2 Sharing Is Voluntary and Initiated by You

All shareable content in the Service is generated only when you take a deliberate action to create and share it. We do not automatically share content on your behalf and we do not share content to third-party platforms without your initiation of the share action. The decision about what to share, with whom, and through which platform rests entirely with you.

Before sharing any card, consider what the card reveals about you. In particular, the Annual Review Card and the Milestone Share Card contain information about the duration and depth of your engagement with the Service. If you prefer not to disclose this to a recipient, you may choose not to share those card types.

22.3 Loss of Control After Sharing

Once you share content via a third-party platform, Mitr has no control over what happens to it. Content shared via WhatsApp, Apple Messages, Instagram, or any other third-party application may be forwarded, saved, screenshotted, re-shared, or stored by the recipient or by the platform indefinitely, beyond what Mitr can influence, monitor, or reverse. Mitr is not responsible for any further distribution or use of content once it has been shared externally.

If a shared card contains information you later wish had not been shared — including the text of an intention post or personal engagement data from your Annual Review — you should contact the recipient directly to request deletion. Mitr cannot retrieve, delete, or restrict content that has already been shared externally.

22.4 Third-Party Sharing Platforms

Sharing content through WhatsApp, Apple Messages, Instagram, or any other platform is governed by that platform's own terms of service and privacy policy. Mitr is not a party to your use of those platforms and has no visibility into how those platforms process, store, or transmit shared content. Before sharing, you should be aware of the privacy practices of the platform you use.

22.5 Mitr Attribution and Branding on Shared Cards

All shareable cards generated by the Service include Mitr attribution — the Mitr name, mark, or tagline, and a reference to bewithmitr.com. This attribution is embedded in the card design and is not removable by the user before sharing. It identifies the content as originating from Mitr and is part of how the Service operates.

The verse content displayed on Mitr share cards reflects Mitr's own rendering of source texts from the Bhagavad Gita and related corpus. These renderings are the intellectual property of Zarsh Services Inc. and may not be reproduced, extracted, or republished in commercial contexts beyond the personal sharing use described in this section without our prior written consent.

22.6 Sharing Attribution Data Collected by Mitr

When you share content from the Service, the Service records that a share action occurred, the type of card shared, and the time of sharing. This data is used to understand how sharing features are used and to improve the Service. We do not receive data about who received your shared content or what they did with it.

22.7 No Warranty Regarding Shared Content or Its Reception

Mitr makes no representation or warranty regarding how shared content will be received, interpreted, or used by any recipient. Sharing a verse card, milestone card, or any other content generated by the Service does not constitute advice — spiritual, medical, psychological, or otherwise — from Mitr to the recipient. Mitr is not responsible for any consequence arising from a recipient's response to, or use of, content you have shared.

In particular, if you share content that contains information about your emotional state, spiritual practice, or wellbeing (such as an intention post or an Annual Review card), Mitr is not responsible for any reaction by the recipient, any discussion that follows, or any outcome — positive or negative — that may result from that sharing.
