Please read these Terms carefully before using Mitr. By downloading, installing, or using the Service, you enter into a binding legal agreement with Zarsh Services Inc. If you do not agree to these Terms, do not use the Service.

Section 01

Definitions

The following terms have the meanings set out below wherever they appear in these Terms, whether capitalized or not.

Section 02

Acceptance of Terms

By downloading, installing, registering for, or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms form a binding legal agreement between you and Zarsh Services Inc.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and references to "you" include that organization.

If you do not agree to these Terms, you must not download, install, or use the Service.

Section 03

Eligibility

The Service is available to users who are 18 years of age or older. By using the Service, you represent and warrant that you meet this requirement.

One minimum age, everywhere: Minimum ages for digital services differ from country to country. India's Digital Personal Data Protection Act 2023 treats anyone below 18 years of age as a child. Rather than apply a different rule in each country, we set a single minimum age of 18 worldwide. If you are under 18, you may not create an account or use the Service in any country.

In jurisdictions where the minimum age for entering into binding contracts or using digital services is higher than 18, the higher age threshold applies and you must meet it to use the Service. If you do not meet the applicable age requirement in your jurisdiction, you must not use the Service.

We reserve the right to request verification of your age at any time and to suspend or terminate accounts where the applicable age requirement is not met.

Section 04

Account Registration and Security

4.1 Creating an Account

To access most features of the Service, you must register for an account. You may register using an email address and password, or through an authorized single sign-on provider (currently Google Sign-In and Sign in with Apple). You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at privacy@bewithmitr.com if you become aware of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account.

4.3 One Account Per Person

Each account is personal to you and may not be shared with or transferred to any other person. You may not create multiple accounts for the purpose of circumventing usage limits, free trials, or any other restriction.

4.4 Account Suspension and Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. See Section 19 for full termination terms.

Section 05

What Mitr Is and Is Not

This section is important. Please read it. Mitr is a personal companion application grounded in the wisdom of the Bhagavad Gita and related texts. It is designed to support everyday equanimity and inner reflection. It is not a medical service, a mental health treatment, a therapy platform, or a substitute for professional care of any kind.

You are solely responsible for any decisions you make based on your use of the Service. We encourage you to seek qualified professional support for any serious personal, health, or mental health concern.

Section 06

Subscriptions and Payment

6.1 Subscription Plans

Mitr offers the following subscription plans for access to Premium features:

Prices are displayed in your local currency where the App Store or Google Play Store supports this. The price displayed at the time of purchase is the price you will be charged. Prices are subject to change; any change will be communicated to you with reasonable notice before it takes effect on your renewal.

6.2 Billing Through App Stores

All subscription purchases are processed exclusively through the Apple App Store or the Google Play Store, depending on your device. Zarsh Services Inc. does not collect or store your payment card details. Payment is governed by the terms of the applicable app store platform. By purchasing a subscription, you also agree to the payment terms of the Apple App Store or Google Play Store, as applicable.

6.3 Auto-Renewal

Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date. Your payment method on file with the App Store or Google Play Store will be charged for the renewal at the then-current subscription price. You will not receive a separate notice before each automatic renewal; it is your responsibility to manage your subscription through the relevant app store settings.

6.4 Price Changes

We may change subscription prices at any time. If we increase the price of your current subscription plan, we will notify you in advance of your next renewal date. Your continued use of the Service after the new price takes effect constitutes your acceptance of the new price.

Section 07

Free Trial

We offer a 30-day free trial of the Premium subscription for new subscribers.

At the end of your free trial, your subscription will automatically convert to a paid subscription at the applicable plan price unless you cancel before the trial ends. You will be notified before the trial ends. The free trial is available to new subscribers only. We reserve the right to determine eligibility for the free trial and to modify or discontinue the trial offer at any time.

Only one free trial per person, per Apple ID or Google account, is permitted.

Section 08

Cancellation and Refunds

8.1 How to Cancel

Because subscriptions are billed through the Apple App Store or Google Play Store, cancellation must be managed through the relevant platform's subscription settings — not through Mitr directly. To cancel your subscription:

Cancellation takes effect at the end of the current billing period. You will retain access to Premium features until that date. Cancellation does not entitle you to a refund for any portion of the current billing period already paid.

8.2 Refunds

All refund requests are handled by the Apple App Store or Google Play Store under their respective refund policies. Zarsh Services Inc. does not have the ability to issue refunds directly for subscription purchases made through those platforms. Refunds are not guaranteed and are subject to the platform's discretion.

If you believe you are entitled to a refund under applicable consumer law in your jurisdiction, please contact the relevant app store platform or contact us at team@bewithmitr.com and we will do our best to assist.

Section 09

User Content — The Intention Wall

9.1 Your Responsibility for User Content

When you post an intention on the Intention Wall, you are solely responsible for the content of that post. By posting, you represent and warrant that:

9.2 License to Mitr

By posting User Content on the Intention Wall, you grant Zarsh Services Inc. a non-exclusive, worldwide, royalty-free, sublicensable license to use, store, display, transmit, and process that content solely for the purposes of: operating the Intention Wall; displaying the content to other users as described in our Privacy Policy; running the automated safety check described in Section 12; generating the anchoring verse associated with your post; and producing the anonymized community themes feature. This license lasts for as long as your content exists in our systems and terminates when your content is deleted in accordance with our Privacy Policy.

You retain ownership of your User Content. We do not claim ownership of anything you post.

9.3 Editing Intentions

You may edit the text of your intention within 15 minutes of posting. After this window closes, the text of your intention is fixed for the remainder of its time on the wall. You cannot delete an intention post once it has been published. See our Privacy Policy, Section 21.10, for full details.

You agree not to post User Content that:

We reserve the right to review and remove any User Content that, in our sole judgment, violates these Terms, our content standards, or is otherwise harmful to users or to the community. Removal may occur with or without notice to you. User Content may also be reviewed based on feedback submitted through the in-app feedback mechanism. We are not obligated to monitor all User Content but reserve the right to do so.

Section 10

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

Violation of the Acceptable Use policy may result in immediate suspension or termination of your account at our sole discretion.

Section 11

Intellectual Property

11.1 Mitr's Intellectual Property

The Service and all of its Content — including but not limited to the Mitr App, brand identity, mark, wordmark, tagline, design system, verse corpus, AI-generated verse renderings, AI companion response templates, system prompts, features, and any software, text, graphics, and audio — are the intellectual property of Zarsh Services Inc. and are protected by copyright, trademark, and other applicable intellectual property laws.

Nothing in these Terms transfers any intellectual property rights to you. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial purposes in accordance with these Terms.

11.2 Source Texts

The Bhagavad Gita, Uddhava Gita, and related Vedic and Vaishnava texts from which Mitr draws its verse corpus are ancient works in the public domain. However, Mitr's renderings of those texts — the specific language, presentation, and interpretive framing used in the Service — are original creative works of Zarsh Services Inc. and are protected by copyright.

11.3 AI-Generated Content

Content generated by the Mitr AI companion in response to your messages is produced for your personal use within the Service. You may use AI-generated responses for your own personal, non-commercial reflection. You may not reproduce, distribute, or publish AI-generated responses at scale or for commercial purposes without our prior written consent.

11.4 Feedback

If you submit feedback, suggestions, or ideas about the Service through the in-app feedback mechanism or otherwise, you grant us a perpetual, worldwide, royalty-free license to use that feedback without obligation or compensation to you.

11.5 Reporting Infringement

If you believe that content in the Service infringes your intellectual property rights, contact us at privacy@bewithmitr.com with a description of the allegedly infringing material and your contact information.

Section 12

AI Features and Limitations

12.1 Nature of AI Responses

The Mitr AI companion generates responses using a large language model operated by Anthropic, Inc. Responses are probabilistic outputs of an automated system. They are not authored by a human and do not reflect the views, opinions, or endorsements of Zarsh Services Inc. or any spiritual, medical, or other professional authority.

AI-generated responses may occasionally be inaccurate, incomplete, inconsistent, or not appropriate for your specific circumstances. You should not rely on AI companion responses as a substitute for professional advice of any kind.

12.2 Verse Renderings

Verse content presented in the Service reflects Mitr's own interpretive renderings of source texts and is designed to be accessible and relevant to everyday life. These renderings are not verbatim translations and have not been certified or endorsed by any religious, academic, or spiritual authority. For scholarly or devotional use, we recommend consulting authoritative translations from qualified sources.

12.3 Automated Safety Features

The Service includes an automated safety layer that checks content — including intention posts and AI companion messages — for indicators of crisis or self-harm before processing or publication. This system is automated and may not detect every instance of distress. If you or someone you know is in crisis, do not rely on this system — contact a crisis service directly. Crisis resources are listed in our Privacy Policy, Section 14, and are available at all times within the App.

12.4 No Continuity of Advice

The AI companion does not retain memory between separate sessions beyond the last 10 messages in a given conversation. Responses are generated fresh in each session context. Mitr makes no representation that the AI companion will provide consistent, continuous, or longitudinally coherent guidance over time.

Section 13

Events, Venues, and Gatherings

The Service may present recommendations for in-person events, spiritual centers, and wellness venues sourced from third-party data providers including the Google Places API. The Service may also allow users to discover community gatherings. The following terms apply to all such features.

13.1 No Endorsement

The inclusion of any venue, event, or gathering in the Service does not constitute an endorsement, certification, or approval by Mitr of that venue, its operators, its activities, or any individual associated with it. Mitr does not verify the accuracy, safety, legality, or suitability of any venue or event displayed in the Service.

13.2 Your Decision to Attend

Any decision to attend an event, visit a venue, or participate in a gathering recommended or listed through the Service is made entirely at your own risk. You are solely responsible for conducting your own assessment of the safety and suitability of any event before attending. Mitr expressly disclaims all liability for any personal injury, property damage, financial loss, or any other harm arising from your attendance at, or travel to or from, any event or venue.

13.3 No Guaranteed Outcomes

Attendance at any event or venue recommended through the Service does not guarantee any spiritual, mental, physical, emotional, or other outcome. Mitr makes no warranty, express or implied, that any event or venue will meet your needs or expectations.

13.4 Third-Party Data Accuracy

Venue and event data sourced from third parties such as the Google Places API is provided as-is. Mitr is not responsible for errors, omissions, or outdated information in third-party data.

Section 14

Shareable Content

The Service allows you to generate and share formatted content cards — including verse cards, milestone cards, community theme cards, and other content — via third-party messaging and social platforms.

14.1 Your Choice to Share

All sharing is voluntary and initiated by you. We do not share content on your behalf without your action. You are responsible for the content you choose to share and for the recipients you choose to share with.

14.2 Loss of Control

Once you share content via a third-party platform such as WhatsApp, Apple Messages, or Instagram, Mitr has no control over how that content is further shared, saved, distributed, or used by the recipient or by the platform. Mitr is not responsible for any consequence arising from content that has been shared externally.

14.3 Attribution

All shareable cards include Mitr attribution embedded in their design. This attribution is not removable. By sharing a card, you acknowledge that the Mitr name and branding will be visible to recipients.

14.4 No Warranty to Recipients

Mitr makes no representation or warranty to recipients of shared content regarding the accuracy, completeness, or suitability of that content for any purpose. Sharing a card does not create any relationship between Mitr and the recipient.

Section 15

Third-Party Services

The Service integrates with and relies on third-party services including Google Firebase, Supabase, Anthropic, ElevenLabs, and the Apple App Store and Google Play Store. Your use of those services is governed by their own terms of service and privacy policies. Mitr is not responsible for the practices, availability, or content of any third-party service.

The Service may contain links to third-party websites or applications. These links are provided for convenience only. Mitr does not endorse, control, or accept responsibility for any third-party site or application and is not liable for any loss or damage arising from your use of them.

Section 16

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by applicable law, Zarsh Services Inc. expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.

We do not warrant that:

Some jurisdictions do not allow the exclusion of implied warranties. In those jurisdictions, the above exclusions apply to the fullest extent permitted by applicable law.

Section 17

Limitation of Liability

To the fullest extent permitted by applicable law, Zarsh Services Inc. and its officers, directors, employees, agents, and service providers will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including but not limited to loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

In no event will our total aggregate liability to you for all claims arising out of or in connection with these Terms or the Service exceed the greater of: (a) the total amount you paid to us in subscription fees in the twelve months immediately preceding the event giving rise to the claim; or (b) USD 100.

This limitation applies regardless of the legal theory on which the claim is based — whether in contract, tort (including negligence), strict liability, or otherwise — and even if any limited remedy fails of its essential purpose.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the fullest extent permitted by applicable law.

Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for fraud, personal injury caused by our negligence, or death.

Section 18

Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Zarsh Services Inc. and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or in connection with:

Section 19

Termination

19.1 Termination by You

You may stop using the Service at any time by deleting your account from within the App or by contacting us at team@bewithmitr.com. If you have an active subscription, you must cancel it separately through the Apple App Store or Google Play Store before deleting your account (see Section 8.1). Deleting your account does not automatically cancel your subscription, and you will continue to be billed until you cancel through the relevant platform.

19.2 Termination by Mitr

We may suspend or permanently terminate your account and access to the Service at any time, with or without notice, if we determine in our sole discretion that you have violated these Terms, engaged in conduct harmful to other users or to the Service, or for any other reason we consider necessary to protect the Service, our users, or our business. Where termination is not for cause, we will make reasonable efforts to provide advance notice.

19.3 Effect of Termination

Upon termination of your account for any reason:

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions.

Where mandatory consumer protection or other laws in your country of residence provide rights that cannot be excluded by choice of law, those rights are not affected by this section. In particular, users located in the United Kingdom, Australia, India, Singapore, and the United Arab Emirates may have rights under local law that apply regardless of this governing law clause.

Section 21

Dispute Resolution

21.1 Informal Resolution First

Before initiating any formal legal proceeding, you agree to attempt to resolve any dispute informally by contacting us at privacy@bewithmitr.com with a written description of the dispute and your proposed resolution. We will make a good-faith effort to respond within 30 days.

21.2 Binding Arbitration (US Users)

If you are a resident of the United States and a dispute cannot be resolved informally, you and Zarsh Services Inc. agree to resolve it through binding individual arbitration administered by a recognized arbitration body under its applicable rules, rather than in court, except as provided below. The arbitrator's decision will be final and binding. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

The following are excluded from arbitration and may be brought in a court of competent jurisdiction: (a) claims that qualify for small claims court; (b) claims relating to the infringement or misappropriation of intellectual property rights; (c) claims seeking emergency injunctive or other equitable relief to prevent imminent harm.

21.3 Class Action Waiver (US Users)

To the fullest extent permitted by applicable law, you and Zarsh Services Inc. each agree to bring any dispute only on an individual basis and not as part of any class, consolidated, or representative action. You expressly waive your right to participate in a class action lawsuit or class-wide arbitration. If this waiver is found to be unenforceable, the entirety of Section 21.2 is void and disputes will be resolved in court.

21.4 Non-US Users

If you are located outside the United States, any dispute that cannot be resolved informally will be subject to the jurisdiction of the courts of King County, Washington, United States, except where mandatory local law provides otherwise. You agree to submit to the personal jurisdiction of those courts for such purposes.

Section 22

Apple and Google — Platform Terms

22.1 Apple App Store

If you download or use the App through the Apple App Store, the following additional terms apply:

22.2 Google Play Store

If you download or use the App through the Google Play Store, your use is additionally governed by Google's Terms of Service available at policies.google.com/terms. In the event of a conflict between these Terms and Google's Terms of Service regarding the App, these Terms will govern to the extent of the conflict, except where Google's terms are mandatory.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, the Service, or applicable law. When we make material changes, we will:

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and cancel any active subscription.

Section 24

General Provisions

24.1 Entire Agreement

These Terms, together with the Privacy Policy incorporated by reference, constitute the entire agreement between you and Zarsh Services Inc. regarding the Service and supersede all prior agreements, representations, or understandings relating to the same subject matter.

24.2 Severability

If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be unenforceable, invalid, or illegal, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions will continue in full force and effect.

24.3 No Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Zarsh Services Inc.

24.4 Assignment

You may not assign or transfer these Terms or any rights granted under them without our prior written consent. We may assign these Terms and any rights granted under them freely, including in connection with a merger, acquisition, or sale of all or substantially all of our assets, without your consent.

24.5 Force Majeure

We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, pandemic, war, terrorism, labor disputes, governmental action, or failure of third-party services or infrastructure.

24.6 Language

These Terms are written in English. In the event of any conflict between an English version and a translation, the English version prevails.
